Today the Georgia Supreme Court struck down the statute providing for caps on damage awards in medical malpractice cases. In short, the Court held that the caps violate the constitutional right to trial by jury.
Now, interestingly, I keep hearing Republicans that are opposed to Obama's healthcare reform say that he is trying to "destroy our freedoms" and is "trampling on the Constitution." These same Republicans say that the way to really reform healthcare is to impose restrictions on medical malpractice cases.
Now, my copy of the U.S. Constitution contains a right to trial by jury in civil cases. Maybe some of these Republicans that are so big on the Constitution, yet in favor of medical malpractice "reform," need to take another look at the Bill of Rights. Probably, they have just forgotten about the 7th Amendment. I am sure they aren't being hypocritical on this issue.
